The other "Directors" of the company were acquitted on the basis that there was no case to answer for them. Its interesting in the current regulatory climate that the "nominee" defence would hold up, but it obviously has. I wonder if this will have wider implications for CSPs. For example if you choked the Bishop you might go down for longer than if you spanked the monkey - although some animal rights bods may disagree. Not read the report, although I will, because if it does allow some mitigation for 'nominees' (no such thing, I have always believed) it would be a very interesting development. Is it not more that the acquitted directors were not actively involved in the scam but took every step a reasonable, professional person acting in that capacity could be expected to take? From what I know, the "nominee" defence did not hold up, the case against the 3 CSP "nominee" directors/company secretary was dropped for another reason. Where "nominee" directors have not taken part in the "crime" and taken all reasonable steps, this has not prevented them being punished in the past by the IOM courts. Unfortunately certain CSP's will continue to bring the IOM under the spotlight for the wrong reasons, this not being the CSP in questions first court case and most certainly not its last.
