ian rush Posted February 16, 2009 Share Posted February 16, 2009 Basically it seems bald reliance on 'technical reasons' is not an exceptional grounds justifying a refusal to pay compensation as maintenance of the aircraft is inherent in the business of the operator and therefore a failure in that regard is *generally* not exceptional. For those of you that have had flights cancelled it may be possible to bring claims, albeit there may be some issues with regard to ‘double recovery’ if you have been paid out by your travel insurers. I’m not aware of any ruling in the Isle of Man but have followed up the issue with Flybe after they cancelled a flight I was on with a group last year.
