That’s because it relates to Manx common law relating to land ownership. if you own a plot of land are you entitled to allow those you want, and restrict those you don’t want, from crossing it? The answer is yes, unless there’s a registered right of way in the Deeds or Land Registry. There’s nothing in writing. It’s the law. Turn the question in the FoI on its head. Does the land belonging to Braddan Commissioners, and upon which the Round House is built, have the benefit of a written right of way over the Nobles Hospital Estate? Both Braddan Commissioners and DHSC are both at fault. Braddan Commissioners have made a complete dog’s breakfast and the ratepayers will end up paying, whilst the DHSC and Minister Hooperman are playing power games with each other.
