It’s irrelevant what end of the scale - he has admitted his guilt. Lessons will be learned shouldn’t come into it, he should never have done it in the first place.

3 of the images were not digital for fucks sake. He'd presumably printed them. By accident?

Except it probably isn't the COPINE scale.  We have this every time one of theses cases turns up: if it's the 1-5 ranked scale that usually seems to be used in the Manx courts, the numbers mean different things (SAP Scale).  All explained in this Wiki article:

Though, as also explained in the above, even that SAP Scale has been superseded for nearly a decade in the English courts.  It's just amateurishness on the part of the Police and media, getting something wrong and just repeating it because they are too lazy or arrogant to get it right.

With the benefit of hindsight his views on electronic tagging expressed in this YouTube link are fairly ironic. Clearly someone who should be electronically tagged on release.

Who decides which scale to apply? Is it the police, the courts or some other authority?

Ity's a problem with our court system, not just in cases like this!

might be true for something like drunk and disorderly you know an offence where if convicted or cautioned it's not going to really have much impact on your life but a charge where you are labelled a sex offender, yeah that's one you fight. 

 

Alternately he may have pleaded guilty because he was guilty, far out concept I know.

It’s the copine scale the police, prosecution and courts work to hear. Heavens knows why. The press reporting is accurate.

If it's copine it'll be context. E.g. the images were saved in a folder alongside regular porn.
