Ice Cream Wars

The owner of Gelato has posted a complaint that DEFA has cancelled his booking in their tent at the agricultural show, because there is an exclusivity deal in place. He's not happy. So it looks like the show's organisers are stifling local business, and that the government has been incompetent, BUT it now appears he knew about the exclusivity because he had previously bid for it himself and been unsuccessful. Those of a nervous disposition who remember events in Scotland a few years ago may wish to look away.

I saw that. It’s just a dick move, losing a tender and then flinging mud at the company that did win that tender. Exclusivity isn’t unusual and it attracts a higher fee, and this is just throwing your toys out of the pram.

Why did they accept his booking if there was an exclusivity arrangement in place?

It looks as though DEFA accepted the booking for a space in the DEFA marquee and then the show organisers pointed out that there’s an exclusivity agreement with Davisons.

Davisons are, presumably, paying a big fat sponsorship fee to the show organisers for that exclusivity. We all know these shows are reliant on sponsorship income to survive.

So it sounds very much like DEFA sold something that they should never have sold and now Davisons are bearing the brunt of a mass pile-on.

What will be interesting is whether Gelatory knew there was an exclusivity agreement in place when they made the booking with DEFA. The rumour is they did and lost a tender. From the outside it looks as though Gelatory knew exactly what they were doing and were trying to sneak in the back gate.

but as usual DEFA didn't have a clue.

i guess a question to ask is are gelato and ice cream  the same thing legally ??  technically there are differences, if davisons have exclusivity for 'ice cream' how is gelato infringing on that ?

personally i prefer gelato from bucks road over the  other company.

Lots of speculation there, it's probably only fair to point out.

This is a mess derived from the cancellation of the Food and Drink Festival.  DEFA promised extra space in their tent to local producers to promote their wares, but presumably didn't expect someone to try to use it as a full commercial pitch.  Apart from anything else they're not going to want long queues for ice cream cluttering up their marquee.

Well yes, because the only public comment has been Gelatory throwing their toys out of the pram. And lots and lots of people posting vicious comments on Facebook about Davisons.
