If the defence succeeds it suggests an identical twin could literally get away with murder because it would be very difficult to prove which twin committed the crime. Its possible his defence is that he has a twin brother somewhere who was parted from him at birth. If so the would probably need testimony from his Mother (if alive). Otherwise hospital records may reveal existence of another.
